The documentation process begins at two fronts - one is the Investment side for which we at TC Global help the investors do the basic documentation. The other is the legal side for which a checklist is provided by the law firm to the client, who then is required to furnish the documents based on his/her Source of Fund (SoF) strategy. The USCIS also does a background check on the investors’ immigration and criminal records. At the second stage of the EB-5 Program, which involves filing a petition to have the conditions of the Green Card removed (I-829 petition), the investors are required to show that a minimum of 10 new jobs was created for a minimum of 2 years since investment. This requirement is met by the Regional Center/Asset Manager in order to fulfil the conditions of the Conditional Green Card.
