So far as the repayment is concerned, it is subject to two conditions - I-829 petition being filed on time and the loan tenure of the term loan matures. So, there are two conditions that needs to be met to trigger capital repayment, the maturity of the loan term and the filing of the I829 petition by the immigration attorney, which highlights that 10 full time jobs have been created in the two-year period that the EB-5 capital remained invested ‘’at risk’’. It is important to note that per the law it is required that both the immigration cycle and the investment cycle are complete before the capital is repaid back to the immigrant investor.
