Once the Source of Funds (SoF) documentation for EB-5 investment is complete, the law firm gives the immigrant investor a go-ahead to wire the investment funds. The investment fund is transferred along with associated investment fees to the Regional Center. The investment funds are transferred into an escrow account for the purpose of investment into a New Commercial Enterprise (NCE), which is primarily a high caliber real estate project in the United States (US). After the investment amount is transferred, the first petition, namely I-526 is filed with the United States Citizenship and Immigration Services (USCIS), which is the US federal agency that oversees lawful immigration to the United States.
After the approval of the EB-5 I526 petition, US Government grants the immigrant investor two years conditional access to the US. Following from the conditional green card period, the immigration attorney goes ahead and files the I829 petition, approval on this gives the EB-5 investor the permanent green card. Once this is granted, the family comprising the primary applicant, their spouse and any number of unmarried children under the age of 21 access to the US with permanent green card.
